POST-DOCTORATE PROGRAM

            The postgraduate program in legal sciences (PPGCJ) of the University Center of Maringá (UNICESUMAR), offers annually the possibility of post-doctoral training linked to the area of Personality Rights, with a scholarship from CAPES (National Post-Doctorate CAPES n. 86/2013), for a period of 12 (twelve) months, and may be renewed up to 60 (sixty) months, according to the evaluation of the performance of the activities of the scholar.

 

PROGRAM REVIEW

            The postgraduate program in Legal Sciences of UNICESUMAR has a triennial journal, nominated by Revista Cesumar Jurídica, whose scientific production is directed to personality rights, having a Quais B in its evaluation, along with the periodic evaluation of CAPES, with an existence of 14 (fourteen) years. ISSN 1677-6402 (Printed) and ISSN 2176-9184 (On-line).

  • According to art. 40 of the Program’s Regulations, modern foreign language proficiency is compulsory for all students enrolled in the Postgraduate Program at the MS level. The Program may take one of the following foreign languages for the proficiency exam: German, Spanish, French, English or Italian.

POSTGRADUATE PROGRAM IN LEGAL SCIENCES

 

HISTORICAL PRESENTATION

 

            The Postgraduate Program in Legal Sciences (PPGCJ) is part of the teaching and research structure of the CENTRO UNIVERSITÁRIO DE MARINGÁ, which maintains UniCesumar, a modern higher education institution, located in a city with approximately 400,000 inhabitants in the northwest of Paraná, known as Maringá. The achievement of grade 4 results in the General Course Index (IGC) in the years 2011, 2012, 2013, 2014 and 2015, provided the University Center of Maringá the ability to be considered among the best private institutions in the south of Brazil. Thus, at 26 years of existence with good ENADE results, it is among the 4% of the Higher Education Institutions of the country. Currently, 50 undergraduate courses are offered, distributed in all areas of knowledge, providing access to higher education to more than 70 thousand students, between classroom and distance learning (EAD) and 4 master degrees programs. Its faculty in 2015 was constituted by 900 teachers, of which 80% have the title of master or doctor. An important achievement in 2012 was the authorisation by the Ministry of Education (MEC) for the operation of the Medicine course, with 100 annual vacancies. Already in 2014 obtained from the Secretariat of Regulation and Supervision of Higher Education authorisation to increase from 100 to 136 vacancies per year.

            Since 2008, the Pro-Rectory for Research, Graduate and Extension (PRPPGE) has become an official part of the Unicesumar structure, providing all necessary support for the development of research, postgraduate and extension activities. PRPPGE has adequate facilities and all the necessary infrastructure for the smooth running of its activities. It is composed of three boards: Research; Postgraduate and Extension. It also has individual rooms for teachers of Stricto Sensu Postgraduate Programs and for students. At the Lato Sensu Postgraduate Course, in 2015, 45 courses were offered, of which 35 are in operation, with a total of 907 students.

            In particular, the Institute of Science, Technology and Innovation (ICETI) was created, an organ in partnership with Unicesumar, and allows the funding of research projects developed by the institution’s teachers and the local community.

            The institution defined in its strategic planning: to obtain the status of University. In order to do so, it initiated in 2012 the first actions. As early as 2013, it began the process of expansion, both territorial and performance. A further 5 campuses were opened in the state of Paraná, being: Londrina, Arapongas, Guarapuava, Ponta Grossa and Curitiba. In distance education, it implemented and obtained authorization to operate 27 undergraduate courses and 21 lato sensu postgraduate courses, of which 8 are MBA courses.

            Between the years of 2012 and 2015, it expanded to 58 hubs in 13 Brazilian states. In the stricto sensu postgraduate course, in 2013, it obtained a recommendation for two more academic master’s programs: PPG in Clean Technologies and PPG in Knowledge Management in Organizations, which began in 2014. In 2014 the discussion and elaboration of the Projects began for the accreditation of two more academic masters.

            The postgraduate program in Legal Sciences (PPGCJ) of the University Center of Maringá (UNICESUMAR) is a program authorized and recommended by CAPES since 2005, whose main purpose is especially to train people in the area of law, at the level of so that the person becomes a researcher in the scientific area, as well as a professional qualification for the exercise of teaching in the area of law in our country.

            The course has been in existence since 2005 and, to date, has trained 242 masters, with professional activity in several states of the Brazilian Federation, currently counting with 78 enrolled in the current academic year of 2016.

            It is a postgraduate course located in the Southern Region of Brazil, headquartered in Maringá – Paraná State and linked to UNICESUMAR, however, it receives a clientele from several other states of the Federation such as: Mato Grosso, Mato Grosso do Sul, Santa Catarina, Rio Grande do Sul, São Paulo, Goiás.

Personality Rights

            The context of research on personality rights lies in the transformation of the theory that enshrined them in the nineteenth century until the first half of the twentieth century. The second half of the twentieth century and the beginning of the twenty-first century imposed transformations arising from Wars, the technological and scientific revolution and the globalization of the discussion of the dignity of the human person (human, fundamental and personality rights). The current moment is the re-signification of the individual, the environment, the genetic and cultural patrimony and their manipulations, the protection of minorities and vulnerable groups. In this transformation context, the law assumes roles and functions as trendsetter of interests, instrument of effectiveness, institutional arranger and vocalizer of demands. It is also pressed for an epistemic opening to promote a dialogue like other scientific knowledge that investigates the same objects and realities.

Research Line 1 – PERSONALITY RIGHTS AND ITS REACH IN CONTEMPORANEITY

 

            It discusses the new rights of the personality and the limits of its protection in the present time. Thus, the studies developed in this segment aim to deepen the dimensions that these new rights have assumed in today’s society, as well as to delimit the scope of their protection, insofar as they may conflict with existing traditional rights and with new rights in development. In this line, theoretical studies concerning the new challenges of the integral protection of the individual (human, fundamental and personality rights) in their culture or cross-cultural interactions across borders, the dignity of the human person, the person belonging to minorities and vulnerable groups and the new family configurations, as well as analysis of the reflexes of these rights in social organizations, in public and private entities, and in the relations of work, consumption, education, biology, modern technologies and religious revivals that impact the conception about personality and individual existence.

            The line investigates material law, the maintenance and expansion of the rights of the personality in a society of high capitalism individuals, or liquid modernity, which both multiplies and innovates (and discards) environments, cultures, living and beliefs. The search for legal recognition of these rights faced with social conflicts is a milestone for possible new existences. In the near horizon of the research in this line, the epistemic opening for a dialogue with other sciences will allow the extension and the deepening of the approach on the rights of the personality in the contemporary society.

Recognition and Guarantee of Personality Rights
Objective: Identify and study new dimensions of the person’s life in contemporary society capable of supporting research on the recognition and assurance of the traditional and new rights of the personality.

Integral Protection of Person: Interactions on Human Rights, Fundamental Rights and Personality Rights
Objective: Identify and study the new challenges of the integral protection of the individual (human, fundamental and personality rights) in their culture or in their transcultural interactions of the dignity of the human person in contemporary society.

Research Line 2 – EFFECTIVENESS INSTRUMENTS OF THE PERSONALITY RIGHTS

            It studies jurisdictional, state and social instruments for the effectiveness of personality rights. In this order, the aim is the comprehensive conceptual field of efficiency and effectiveness of both the investigated instrument itself and the impact of the solutions with those who hold these rights and the community that gives it context (society, groups, communities, national and international). It uses theoretical approaches and applied research in approximation with other fields of scientific knowledge.

            Also included in this line of research are studies and research concerning access to justice, individual and collective actions on personality rights, independently driven means of solving conflicts of interest in or outside the judiciary system, and the efforts to expand and universalize its use in the world and Brazilian society, and the universe of public policies to achieve and promote the rights of the personality of individuals, minorities and vulnerable groups.

            The line in this propositional horizon focuses on the procedural instruments of effectiveness of the personality rights, investigating the efficiency, efficacy and effectiveness of these instruments; the solutions and impact reached with stakeholders; quality and new instruments in the face of legal security and the search for pacification and democratic ideals.

Jurisdictional Instruments of Personality Rights Enforcement
Objective: To seek access to justice and the quality of the services rendered by the public power, especially the Brazilian judiciary, in the subject of personality rights in the various individual and collective actions, as well as in several conflicts regarding human dignity. To study the jurisdictional instruments of concretising and promoting the rights of the personality of individuals, minorities and vulnerable groups.

Public Policies and Social Instruments for Effective Enforcement of Personality Rights
Objective: To research the public policies of promotion and fulfilment of personality rights. To study the social instruments of concretising and promoting the rights of the personality of individuals, minorities and vulnerable groups.

  1. AREA OF CONCENTRATION: PERSONALITY RIGHTS

The scientific production locus of the Master’s Degree in Legal Sciences program at UNICESUMAR is directed in a large area, called PERSONALITY RIGHTS, and is based on two lines of research:

 

            The Master’s Program contains two lines of research: The first concerns PERSONALITY RIGHTS AND ITS REACH IN CONTEMPORANEITY. In this line, the aim is to redefine the concepts and scope of the actors and objects that make up the rights of the personality, in the context of contemporary constitutional theory, based on the principle of the dignity of the human person. Theoretical studies concerning the individual, the person, the family and social organizations, as well as analysis related to labor relations, the environment, biotechnology, new technologies that impact the conception about the personality, among others, are inserted in this line of research.

 

            The second refers to THE EFFECTIVENESS INSTRUMENTS OF THE PERSONALITY RIGHTS. This line studies legal and extra-legal mechanisms, public policies and actions aimed at the realization of personality rights, using theoretical approaches and applied research. Included in this line are studies on access to justice, legal protection of personality rights, alternative dispute resolution mechanisms, public policy proposals and collective actions for the realization of personality rights, among others.
